Liability Waiver

1. VOLUNTARY MEMBERSHIP. I, the undersigned, acknowledge and state that I have voluntarily applied to join, to become a Member of, and/or to participate in the activities of SLMD LLC. This Agreement applies to all Gym services, including but not limited to: memberships, class bundle packages, drop-in classes, personal training sessions, private or semi-private training sessions, workshops, specialty programs, and open gym use (if applicable).
   
   

2. VOLUNTARY ASSUMPTION OF RISK. I am fully aware and understand that, in general, exercise is a dangerous, hazardous, and potentially deadly activity. In particular, I am fully aware and understand that, by becoming a member of SLMD LLC, I am going to be instructed in and participate in exercise and be exposed to extremely dangerous and hazardous activities. Furthermore, I am also fully aware and understand that engaging in any physical fitness program can be dangerous and that I will be exposed to fitness equipment and facilities that have the potential to cause me serious physical injury. In becoming a member and/or participating in the activities of SLMD LLC, I voluntarily assume any and all risks of death, injury or damage of any kind whatsoever that are in any way connected to my membership in, instruction by, or participation in any activities conducted or sponsored in whole or in part by SLMD LLC to the fullest extent of the law. My voluntary assumption of these risks shall be verified by placing my initials here: _____________
   
   

3. RELEASE OF LIABILITY. In consideration for being: (a) accepted as a member of SLMD LLC; (b) instructed in and about exercise by SLMD LLC; (c) entitled to participate in any and all of the activities conducted or sponsored in whole or in part by SLMD LLC; and (d) permitted to use any and all SLMD LLC facilities and equipment, whether owned or leased by SLMD LLC, in connection with SLMD LLC, its activities, or otherwise (referred to hereinafter collectively as the “activities”), to the fullest extent possible, I hereby fully and forever release: (a) SLMD LLC, its affiliated organizations, and their successors, assigns, officers, directors, members, agents, employees, insurers, representatives and attorneys (referred to hereinafter as “SLMD LLC”); and (b) any and all manufacturers, distributors, wholesalers, suppliers, and/or retailers of SLMD LLC facilities of the equipment that I may use in connection with any and all activities conducted and/or sponsored in whole or in part by SLMD LLC from any and all claims, actions or causes of action, damages, demands, costs, expenses, losses, and attorney’s fees of every kind and nature, which I have, or may claim to have arisen out of or are related to the activities. I agree that the foregoing release shall be binding on my heirs, distributors, guardians, executors, administrators, successors in interest and legal representative. It is my intention that this release will be effective to bar all claims, demands, controversies, causes of action, liabilities, costs, expenses, attorneys’ fees, and damages of whatsoever character, nature and kind, known or unknown, suspected or unsuspected, arising out of or related to the activities. My voluntary agreement to the release of liability shall be verified by placing my initials here. __________

1. CHOICE OF LAW, VENUE, JURISDICTION. In further consideration of the Activities, I agree to the following: (a) My membership application, the foregoing voluntary assumption of risk, and release shall be governed by and construed in accordance with the internal laws of the State of Maryland, without giving effect to conflict of laws provisions thereof; (b) in the event of any dispute or controversy of any kind whatsoever arising out of my membership and membership application, the foregoing voluntary assumption of risk and release, or the activities, the venues for any legal action arising from or related to such dispute or controversy shall be the appropriate court of the State of Maryland. My voluntary agreement to each of the foregoing sub-paragraph shall be verified by placing my initials here. __________
   
   

2. HEALTH ADVISORY AND CONDITIONS. I hereby acknowledge and understand that the performance, practice and utilization of SLMD LLC instructions involve extremely strenuous physical activity, and that I have been advised to consult a physician before commencing and undertaking such activity. I hereby represent that to the best of my knowledge, I am in good physical health and condition, sufficient to undertake the activities and practices consulting SLMD LLC. __________
   
   

3. RE: RELEASE OF LIABILITY REGARDING COMMUNICABLE DISEASE (Hep B, Hep C, HIV, COVID-19, etc.). In consideration for being: (a) accepted as a member of SLMD LLC; (b) instructed in and about exercise by SLMD LLC; (c) entitled to participate in any and all of the activities conducted or sponsored in whole or in part by SLMD LLC; and (d) permitted to use any and all SLMD LLC facilities and equipment, whether owned or leased by SLMD LLC, in connection with SLMD LLC, its activities, or otherwise (refereed to hereinafter collectively as the “activities”), to the fullest extent possible, I hereby fully and forever release: (a) SLMD LLC, its affiliated organizations, and their successors, assigns, officers, directors, members, agents, employees, insurers, representatives and attorneys (referred to hereinafter as “SLMD LLC”); and (b) any and all manufacturers, distributors, wholesalers, suppliers, and/or retailers of SLMD LLC facilities of the equipment that I may use in connection with any and all activities conducted and/or sponsored in whole or in part by SLMD LLC from any and all claims, actions or causes of action, damages, demands, costs, expenses, losses, and attorney’s fees of every kind and nature, which I have, or may claim to have arisen out of or are related to arising out of or resulting from the transmission of a communicable disease or their transmission to others. I agree that the foregoing release shall be binding on my heirs, distributors, guardians, executors, administrators, successors in interest and legal representative. It is my intention that this release will be effective to bar all claims, demands, controversies, causes of action, liabilities, costs, expenses, attorneys’ fees, and damages of whatsoever character, nature and kind, known or unknown, suspected or unsuspected, arising out of or related to the activities and/or the transmission of a communicable disease or failure to perform services which were either intended to or assumed to prevent communicable disease of their transmission to others. As such, I expressly waive any and all rights and benefits. This agreement will be governed by the laws of the State of Maryland.
   
   

4. PAYMENT. In the event of any dispute arising from member’s failure to pay membership dues or any other money due to SLMD LLC, the prevailing party shall be entitled to recover all actual attorneys’ fees and costs incurred in connection therewith. 

1. MEMBERSHIP FEES. Member agrees to pay the monthly membership fee, which will recur on the date in which the membership began, unless otherwise agreed upon with Gym Management. Payments can be made through an accepted credit card. NOTE: Each declined transaction incurs a fee for the Gym, and as a result, a $150 fee will be applied to the Member’s account each time a payment attempt is declined. To avoid any additional charges, members must keep payment information up-to-date.
   
   

2. NO REFUND POLICY. All payments made to the Gym are final and non-refundable. This includes, without limitation, membership fees, initiation fees, recurring dues, private or personal training fees, class fees, package fees, and fees for any other services or products provided by the Gym. No refunds, credits, or prorated amounts will be issued for unused memberships, unused sessions, missed appointments, early termination, non-attendance, or dissatisfaction with services, regardless of reason, except where expressly required by applicable law.
   
   

3. CLASS RESERVATION AND NO-SHOW POLICY. Members who reserve a class must cancel at least two (2) hours before the scheduled start time. Failure to attend a reserved class, or failure to cancel at least two (2) hours in advance, will result in a No-Show Fee of $20.00 per class. Member expressly authorizes SLMD LLC to charge the No-Show Fee to any payment method on file. Member acknowledges and agrees that this fee is a reasonable estimate of damages resulting from missed attendance and lost booking opportunities, is not a penalty, and is non-refundable except at management’s sole discretion. By reserving a class, Member agrees to be bound by this policy.
   
   

4. CANCELLATION POLICY – PRIVATE TRAINING SESSIONS. Member/Client must provide at least 24 hours’ notice to cancel or reschedule a private training session. Cancellations made with less than 24 hours’ notice, or failure to attend a scheduled session, will result in the session being forfeited and deducted from the client’s package. All private training sessions are non-refundable and non-transferable. By purchasing or scheduling sessions, the member/client agrees to this policy.
   
   

5. CANCELLATION PROCEDURE. To cancel their Agreement, Member must provide written notice to the Gym at least 30 days prior to the desired cancellation date. The notice MUST be sent via email to the Gym to admin@championboxingfitness.com. Requests made in-person, verbally, over the phone, social media, or any other communication channel outside of email are NOT accepted. Failure to follow the steps outlined above may result in processing delays and/or incur additional charges.
   
   

6. MEMBERSHIP FREEZE. In the event of a temporary inability to use the Gym facilities due to injury, illness, or other valid reasons, Member may request a membership freeze. The freeze period shall not extend beyond 30 consecutive days, and membership dues will be suspended during this period.
   
   

7. GYM RULES AND REGULATIONS. Member agrees to abide by all rules and regulations of SLMD LLC as posted and provided by the Gym.
